INTRODUCCIÓ: Les presents condicions generals de la contractació dels continguts i serveis de LACOMBA PRODUCCIONS, S.L. (des d'ara "les Condicions Generals"), estableixen amb caràcter general les regles a les quals se sotmetran LACOMBA PRODUCCIONS, S.L. i l'usuari al contractar aquest els serveis d'aquella, sense perjudici que ambdues parts puguin pactar unes clàusules específiques que anul·lin o modifiquin les a continuació s'exposen. A aquests efectes es considerarà "usuari" a qualsevol persona que accedeixi als continguts de www.lacomba.com, ja es tracti d'un client, d'un interessat a col·laborar amb nosaltres o d'un mer curiós, tal com diferenciem en la nostra web.

L'accés a www.lacomba.com o la contractació per part de l'usuari de qualsevol dels serveis de LACOMBA PRODUCCIONS, S.L. a través de la nostra web suposa l'acceptació de les presents Condicions Generals. Per a qualsevol dubte sobre la interpretació i abast de les mateixes, LACOMBA PRODUCCIONS, S.L., remeti'ns un correu a comercial@lacomba.com.

LACOMBA PRODUCCIONS, S.L. declina qualsevol responsabilitat que pugui originar-se per l'ús indegut dels continguts i serveis inclosos en aquesta web, contravenint l'establert en les presents Condicions Generals, sent responsabilitat única i exclusiva de l'usuari infractor. L'usuari assumirà les responsabilitats, indemnitzacions, sancions i costes que puguin derivar-se d'aquest ús indegut.

ACCEPTACIÓ: l'usuari que accedeixi a www.lacomba.com o contracti qualsevol dels serveis de LACOMBA PRODUCCIONS, S.L., reconeixerà en aquest mateix moment que és major d'edat i amb plena capacitat d'obrar i, en concret, amb capacitat suficient per a perfeccionar la referida contractació i, al seu torn que ha llegit i acceptats, plena i íntegrament totes i cadascuna de les presents Condicions Generals. En el supòsit de persones jurídiques, l'usuari reconeixerà tenir capacitat i representació suficient per a actuar en nom d'aquella, assumint qualsevol responsabilitat que pugui derivar de la falta de legitimitat i representació.

L'acceptació d'aquestes Condicions Generals suposa per a l'usuari utilitzar els continguts i serveis de LACOMBA PRODUCCIONS, S.L. de forma seriosa i diligent i, en tot cas, per a interessos propis de l'usuari, mai per a comercialitzar amb ells enfront de tercers.

LACOMBA PRODUCCIONS, S.L. es reserva el dret d'impedir, sense previ avís, l'accés a qualsevol usuari que infringeixi les presents Condicions Generals o realitzi un ús indegut dels continguts i serveis de LACOMBA PRODUCCIONS, S.L. o que contravingui els interessos d'aquesta empresa.

OBJECTE: Les presents Condicions Generals tenen per objecte regular la publicitat que dels serveis de LACOMBA PRODUCCIONS, S.L. es fa en la nostra web, www.lacomba.com, així com regular l'accés i ús dels continguts de la referida website, que com portal d'informació oferim en la mateixa, i les possibles incidències que d'això puguin derivar-se.

En el lloc www.lacomba.com no existeix plataformes o recursos que permetin la contractació electrònica dels serveis de LACOMBA PRODUCCIONS, S.L. En tot cas, la contractació d'aquests serveis es faran personalment en les nostres oficines, formalitzant, si és procedent, el corresponent contracte i pressupost per escrit.

ÀMBITO TERRITORIAL: Els continguts i serveis prestats per LACOMBA PRODUCCIONS, S.L. a través de www.lacomba.com se sotmeten a la legislació espanyola i, si escau, a la legislació de la Unió Europea.

LACOMBA PRODUCCIONS, S.L. en conseqüència declina la submissió a qualsevol altra legislació que no sigui l'espanyola en cas de litigi sorgit de l'accés i ús dels continguts de www.lacomba.com.

MODIFICACIÓ: LACOMBA PRODUCCIONS, S.L. es reserva el dret de modificar unilateralment les presents Condicions Generals, el contingut i serveis inclosos en la web de LACOMBA PRODUCCIONS, S.L., així com la presentació i imatges que la integren sense previ avís. En tot cas, i pel que fa a una eventual modificació de les Condicions Generals o dels serveis prestats, això no s'aplicarà amb caràcter retroactiu a accessos a la nostra website anteriors a aquesta modificació.

La declaració de nul·litat o ineficàcia de qualsevol de les clàusules que configuren les presents Condicions Generals no implicarà la nul·litat o ineficàcia de les no afectades per la referida declaració.

ARXIU, ACCÉS I ÚS DE CURRICULUMS: LACOMBA PRODUCCIONS, S.L. té habilitat en el lloc www.lacomba.com un apartat destinat a aquells usuaris que interessats a col·laborar amb LACOMBA PRODUCCIONS, S.L. ens vulguin remetre el seu currículum.

Per a això, l'usuari interessat deurà registrar-se amb un nom d'usuari i una contrasenya, després de la qual se li permetrà la remissió per via electrònica del seu correu.

LACOMBA PRODUCCIONS, S.L. durà en un fitxer electrònic creat expressament per a això l'arxiu de tots els Currículum remesos per via electrònica, sense que pugui difondre'ls a tercers sense consentiment exprés de l'usuari, la qual cosa serà sol·licitat per correu electrònic. En el supòsit de no contestar a l'esmentat correu en el termini d'una setmana a contar des de la seva remissió, s'entendrà denegat el consentiment per a difondre a tercers el referit document sobre trajectòria personal.

En qualsevol moment, l'usuari podrà modificar o cancel·lar un currículum remès amb anterioritat, comunicant-ho per escrit, ja sigui mitjançant correu postal dirigit a LACOMBA PRODUCCIONS, S.L., carrer Contestí, 42, 07014 PALMA DE MALLORCA o dirigint correu electrònic a comercial@lacomba.com . Rebut el correu, LACOMBA PRODUCCIONS, S.L. comunicarà haver-se produït la modificació o cancel·lació del Currículum, mitjançant correu postal o correu electrònic.

En tot cas, LACOMBA PRODUCCIONS, S.L. adoptarà totes les mesures tècniques per a assegurar el correcte arxiu dels currículums i aquelles altres que impedeixin l'accés il·legítim per part de tercers. No obstant, no es responsabilitza de l'ús indegut que es faci dels mateixos quan s'aconsegueixi per un tercer vèncer les mesures de seguretat, doncs Internet ofereix deficiències que permeten accessos il·legítims, com els quals realitzen els denominats Intrusos. En cas que s'apreciï intromissió, l'usuari afectat ens el deurà comunicar com més aviat a comercial@lacomba.com per a poder adoptar les mesures oportunes per a evitar accessos il·legítims.

En qualsevol cas, LACOMBA PRODUCCIONS, S.L. es reserva el dret de rebutjar o eliminar dels seus fitxers aquells currículums remesos que no siguin d'interès per a LACOMBA PRODUCCIONS, S.L., adoptant per a això les mesures necessàries perquè quedin totalment destruïts o que resultin impossibles de llegir per part de tercers aliens a LACOMBA PRODUCCIONS, S.L.

POSSIBLES RESPONSABILITATS: LACOMBA PRODUCCIONS, S.L. posa a la disposició dels usuaris una sèrie d'enllaços hipertextuals, amb caràcter il·lustratiu o informatiu, a distintes webs, ja es tractin de clients de LACOMBA PRODUCCIONS, S.L. ja es tracti de webs que considerem interessants. No obstant, LACOMBA PRODUCCIONS, S.L. no es responsabilitza dels contesos d'aquestes pàgines ni dels mals i perjudicis que l'accés a les mateixes puguin ocasionar a l'usuari. Únicament, LACOMBA PRODUCCIONS, S.L. procedirà a eliminar l'enllaç hipertextual en el cas que s'acrediti un contingut il·lícit o la ocasionament d'un mal.

L'usuari que s'asseu ofès per semblants imatges, ens el podrà comunicar dirigint-se a comercial@lacomba.com, davant la qual cosa adoptarem, si és procedent, les mesures oportunes

POLÍTICA DE PRIVACITAT: Informació General sobre Protecció de dades

D'acord amb la Llei Orgànica 15/1999, de 13 de desembre, de Protecció de dades de caràcter personal, procedim a informar-li sobre els extrems exigits pel art. 5 de la mateixa:

Li vam comunicar que LACOMBA PRODUCCIONS, S.L. utilitza un sistema de tractament de les dades de caràcter personal facilitats pels nostres usuaris. En concret, existeixen tres fitxers la finalitat dels quals i destinataris són els següents:
1. Fitxer de Curriculums: La seva finalitat és proporcionar a LACOMBA PRODUCCIONS, S.L. les dades suficients dels usuaris interessats a treballar o col·laborar amb nosaltres per a poder comunicar-nos amb ells.
2. Fitxer de Clients: La seva finalitat és proporcionar a LACOMBA PRODUCCIONS, S.L. les dades suficients dels clients que han ens han contractat algun servei per a poder comunicar-nos amb ells i per a conèixer les seves preferències respecte als nostres productes i serveis, i poder, així, optimitzar, facilitar i personalitzar la nostra labor. També constessin en aquest fitxer dades sobre el nombre de factures emeses per LACOMBA PRODUCCIONS, S.L. que podrà conèixer el client a l'efecte de sol·licitar còpies d'elles a l'adreça comercial@lacomba.com.
3. Fitxer de Curiosos: La seva finalitat és proporcionar unes dades bàsiques (correu electrònic i contrasenya) dels quals accedeixen sense ser clients a la nostra web, a l'efecte de permetre la seva entrada, identificar-los mitjançant una cookie instal·lable en l'equip de l'usuari que permeti reconèixer-ho en pròximes visites.
En qualsevol cas, les dades que se sol·liciten en els nostres formularis són dels denominats pel R.D. 994/1999, de 11de Juny, de caràcter bàsic.

En tots els formularis que utilitzem per a recaptar dades personals dels usuaris o clients, vam indicar amb un asterisc (*) els quals deuen ser respostos amb caràcter obligatori. La seva no resposta, falsedat o inexactitud en la contestació, impedirà poder oferir els productes i serveis per als quals estava destinat el formulari. LACOMBA PRODUCCIONS, S.L. no assumeix responsabilitat alguna pels problemes i errors que puguin derivar-se de les dades inexactes, falsos o incomplets oferts per l'usuari.
Les preguntes que no vengen indicades amb aquest símbol són de resposta voluntària, pel que vostè podrà deixar-les en blanc sense repercussió alguna en la prestació dels nostres serveis.
En qualsevol cas no recaptarem dades personals de l'usuari o client sense el consentiment exprés d'aquest, la qual cosa es confirmarà fent click sobre el botó "ACCEPTO" o similar que constarà per final de cada formulari.
LACOMBA PRODUCCIONS, S.L. i qualsevol persona que intervingui en el tractament de les dades personals inclosos en els nostres fitxers estan obligats al secret professional respecte als mateixos i al deure guardar-los.
Les dades de caràcter personal objecte del tractament només podran ser comunicats a un tercer amb el previ consentiment exprés de l'usuari interessat, la qual cosa es verificarà fent click en la casella "ACCEPTO" del formulari o correu on se li sol·liciti aquesta autorització.
L'usuari o client té reconegut legalment el dret de conèixer, interessant la informació pertinent del Registre General de Protecció de Dades, l'existència de tractaments de caràcter personal, les seves finalitats i la identitat del responsable del tractament. Qualsevol consulta d'aquesta índole és pública i gratuïta.
D'acord amb el art. 15 de la Llei Orgànica 15/1999, de 13 de desembre, l'usuari o client interessat tindrà dret a sol·licitar i obtenir gratuïtament de LACOMBA PRODUCCIONS, S.L. informació de les seves dades de caràcter personal sotmesos a tractament, l'origen de dites dades així com les comunicacions realitzades o que es preveuen fer dels mateixos.
La informació podrà obtenir-se dirigint un correu electrònic dirigit al responsable del tractament de dades comercial@lacomba.com, qui li contestarà de la mateixa manera aportant les dades sol·licitades de forma clara i llegible.

Aquest dret d'accés només podrà ser exercitat a intervals no inferiors a dotze mesos, tret que l'interessat acrediti un interès legítim a aquest efecte, en aquest cas podrà exercitar-los abans.
L'usuari o client que hagi facilitat les seves dades personals a LACOMBA PRODUCCIONS, S.L. tindrà dret a la seva oposició, rectificació o cancel·lació en els termes que a continuació s'indiquen.
Per a això l'interessat deurà dirigir un correu electrònic al responsable del tractament de dades a comercial@lacomba.com o una carta dirigida a l'adreça de LACOMBA PRODUCCIONS, S.L. (Calle Constestí, nº 42, 07014 PALMA DE MALLORCA -ILLES BALEARS-) expressant clarament la seva voluntat de rectificar o cancel·lar les seves dades personals. En el supòsit de rectificació aquesta afirmació vindrà acompanyada de la indicació de les antigues dades que deuen ser rectificats i dels nous que han de substituir-los.

El responsable del fitxer procedirà a la seva rectificació o cancel·lació en el termini màxim de deu dies a contar des de la recepció del correu abans referit.

Les dades de caràcter personal el tractament del qual no s'ajusti a la Llei Orgànica 15/1999, de 13 de desembre i els quals resultin inexactes o incomplets seran rectificats o cancel·lats.

La cancel·lació donarà lloc al bloqueig de les dades personals en qüestió, conservant-se de forma interna durant tres anys únicament a la disposició de les Administracions Públiques, Jutges i Tribunals, per a l'atenció de les possibles responsabilitats nascudes del tractament. Compliment el referit termini, el responsable del tractament procedirà a la seva supressió definitiva.

En el cas que s'hagin comunicat les dades objecte de tractament a un tercer prèviament, el responsable procedirà a notificar a aquest tercer la rectificació o cancel·lació sol·licitada perquè procedeixi en els mateixos termes de rectificar o cancel·lar.
L'usuari, per a qualsevol reclamació en matèria de tractament de les seves dades personals, té dret a fer-ho davant l'Agència de Protecció de Dades.
LACOMBA PRODUCCIONS , S.L. i el responsable del tractament han adoptat els nivells de seguretat de protecció de les dades de caràcter personal que exigeix la Llei 15/1999, de 13 de desembre, amb les pertinent adopció de les mesures tècniques al seu abast per a evitar la pèrdua, mal ús, accés il·legítim, mals o modificació dels mateixos.
No obstant l'usuari o client deurà tenir sempre en compte que les mesures de seguretat en Internet no són innatacables, doncs existeix la possibilitat que s'accedeixi il·legítimament als nostres sistemes i fitxers a pesar d'haver adoptat els més avançats mecanismes tècnics de prevenció.

En el cas que l'usuari o client apreciï un ús indegut de les seves dades personals per tercers deurà comunicar-ho al responsable del fitxer qui adoptarà les mesures pertinents perquè no es torni a produir en el futur, incloent la d'accionar judicialment contra qui hagi accedit il·legítimament a les nostres bases de dades.

Qualsevol usuari que pretengui iniciar accions judicials, administratives o qualsevol altra davant l'Agència de Protecció de Dades o altre organisme competent contra LACOMBA PRODUCCIONS, S.L. i contra el responsable del tractament, deurà comunicar els fets objecte de reclamació a LACOMBA PRODUCCIONS, S.L. prèviament a l'inici de les mateixes, remetent un correu electrònic al responsable del tractament de dades a comercial@lacomba.com o una carta dirigida a l'adreça de LACOMBA PRODUCCIONS, S.L. CONDICIONES GENERALES DE CONTRATACIÓN

INTRODUCCIÓN: Las presentes condiciones generales de la contratación de los contenidos y servicios de LACOMBA PRODUCCIONS, S.L. (en adelante “las Condiciones Generales), establecen con carácter general las reglas a las que se someterán LACOMBA PRODUCCIONS, S.L. y el usuario al contratar éste los servicios de aquélla, sin perjuicio que ambas partes puedan pactar unas cláusulas específicas que anulen o modifiquen las a continuación se exponen. A estos efectos se considerará “usuario” a cualquier persona que acceda a los contenidos de www.lacomba.com, ya se trate de un cliente, de un interesado en colaborar con nosotros o de un mero curioso, tal y como diferenciamos en nuestra web.

El acceso a www.lacomba.com o la contratación por parte del usuario de cualquiera de los servicios de LACOMBA PRODUCCIONS, S.L. a través de nuestra web supone la aceptación de las presentes Condiciones Generales. En el supuesto de personas jurídicas, el usuario reconocerá tener capacidad y representación suficiente para actuar en nombre de aquella, asumiendo cualquier responsabilidad que pueda derivar de la falta de legitimidad y representación.

La aceptación de estas Condiciones Generales supone para el usuario el usar los contenidos y servicios de LACOMBA PRODUCCIONS, S.L. de forma seria y diligente y, en todo caso, para intereses propios del usuario, nunca para comercializar con ellos frente a terceros.

Para ello, el usuario interesado deberá registrarse con un nombre de usuario y una contraseña, tras la cual se le permitirá la remisión por vía electrónica de su correo.
